Nehemia Fuentes Banegas, 26, of Annandale now faces a Class 6 felony carrying up to five years in prison after the Fairfax County Police Department on Thursday released body camera still images and formally charged him with attempted disarming of a law enforcement officer.

Fuentes Banegas is being held without bond at the Fairfax County Adult Detention Center, according to court records reported by Patch.

One released image appears to show Fuentes Banegas in a bush holding the officer's firearm, FFXnow reported. The second shows two utility knives recovered at the scene.

What happened

Officers responded at approximately 9:57 a.m. on Tuesday to a domestic dispute at a home in the 7000 block of Sutter Lane in Annandale, according to the FCPD press release. Fuentes Banegas's wife called police to report he had used two utility knives on himself before fleeing into nearby woods off Americana Drive.

The department said Fuentes Banegas emerged from heavy brush during the search, violently grabbed an officer's firearm, and attempted to disarm him. The officer fired one round while a second officer simultaneously deployed a Taser.

Fuentes Banegas sustained a graze wound on his upper right shoulder. His injuries were non-life-threatening, and he was transported to the detention center after being medically cleared.

Investigations and what's next

Three parallel investigations are now underway: the Major Crimes Bureau is handling the criminal investigation into the use of force, the Internal Affairs Bureau is conducting an administrative review, and the Office of the Independent Police Auditor is performing an independent investigation.

The officer involved is a 12-year veteran of the FCPD's K9 unit who has been placed on restricted duty. His name is expected within 10 days of the July 30 announcement. Full body camera footage will be released within 30 days, per department policy.

FCPD Chief Kevin Davis said at a July 28 briefing that Fuentes Banegas would also face a felony assault charge against a police officer. However, that charge does not appear in court records or the department's press release as of July 30. Davis also said additional charges related to the original domestic dispute remained possible.
